Terms and conditions
These terms govern the contractual relationship between you as user and the provider of MietSense. They are a placeholder and will be finalised by a law firm before public launch.
PLACEHOLDER
This page is a placeholder and must be reviewed and released by a licensed law firm before public publication. The fields shown serve solely as structural guidance.
1. Scope
These general terms and conditions apply to the use of the services available at mietsense.com and mietsense.de. The provider is [PLACEHOLDER: company name and address].
2. Subject of service
MietSense is a structured information service in the field of German tenancy law. We systematically analyse publicly available legal sources — laws, supreme-court decisions, administrative regulations, rent indices — based on the inputs of users.
The services include in particular: the free Quick Check, the paid structured report, and the referral of lawyer appointments through our partner law firm.
No legal advice within the meaning of § 2 RDG is provided. A legal assessment of the individual case is provided exclusively by licensed lawyers.
3. Conclusion of contract
The contract for the generation of a paid report is concluded by selecting the service and subsequent confirmation after entering payment details. You will receive confirmation of the contract by email.
4. Prices and payment
The prices of the respective services are shown on the product pages and include statutory VAT.
[PLACEHOLDER: Accepted payment methods (Stripe, SEPA, PayPal), due date, payment service providers]
5. Right of withdrawal for consumers
Consumers are entitled to a statutory right of withdrawal. For digital content, the right of withdrawal lapses when execution of the service has begun with the consumer's express consent prior to expiry of the withdrawal period and the consumer has confirmed acknowledgement that this causes loss of the right of withdrawal.
[PLACEHOLDER: Full withdrawal instructions pursuant to Annex 1 EGBGB including model withdrawal form]
6. Liability
The contents provided as part of the information service are prepared with care but do not replace a legal individual-case assessment. We accept no liability for decisions users make on the basis of our content — for this, legal counsel must be sought.
[PLACEHOLDER: Full liability regulation with limits following review by counsel]
7. Referral of lawyer appointments
Lawyer consultations are provided by our partner law firm [PLACEHOLDER: name of the firm]. The mandate relationship exists exclusively between the user and the firm. MietSense acts as intermediary in arranging the appointment and is remunerated for this by the firm.
[PLACEHOLDER: Detailed regulation on cancellation, refund, firm's fee schedule]
8. Data protection
The processing of personal data is described in our privacy policy.
9. Final provisions
German law applies. Should individual provisions of these terms be or become invalid, this does not affect the validity of the remaining provisions.
[PLACEHOLDER: Jurisdiction, place of performance, severability clause in exact wording following review by counsel]
