Short-term rental (typically under 30 nights) has been subject to tightened regulation since 2024 and falls under automatic platform reporting to borough authorities from 20 May 2026.

Three regulations are central here: the Berlin Misuse-of-Living-Space Prohibition (ZwVbG) with its 90-night cap for letting one's own primary residence, the duty to correctly maintain the residential registration number, and EU Regulation 2024/1028 mandating monthly transmission of booking data to your borough authority from May 2026.

The legal landscape differs substantially between primary residence (genehmigungsfrei within the 90-night cap) and secondary property (generally permit-required). Boroughs also vary in how strictly they enforce fines for violations.
