Do you let apartments long-term and unbefristet?
Anyone letting apartments unbefristet in Berlin that aren't their own primary residence — one or several — faces concentrated 2026 regulations. Rent control, the furniture-surcharge cap, and fixed-term clauses apply simultaneously, regardless of property count.
The Berlin rent-control rules were refined several times in 2024 and 2025. Which reference values from the rent index apply to a specific apartment depends on borough, year of construction, fittings, and floor area — the same logic applies to a single investment apartment and to a portfolio.
Furnished rentals have been subject to tightened transparency requirements since 2024 — and since 2026 a 5 % cap on the furniture surcharge. Fixed-term agreements under § 575 BGB are permitted only on narrowly defined grounds; an invalid fixed term can have substantial consequences.
