Do you operate furnished mid-term rentals?

Furnished rentals with contract durations between 2 and 12 months — typical for business travellers or expats — are the legally most complex constellation on the Berlin rental market in 2026.

Two provisions are central. § 549 (2) BGB defines the rental for temporary use — a narrowly interpreted exemption that disapplies large parts of standard tenancy protection. The prerequisites have been increasingly refined in case law since 2024.

§ 575 BGB governs fixed-term residential tenancies — permissible grounds are narrowly defined, and an invalidly agreed fixed term can mean the tenancy continues unbefristet. The 2026 furniture-surcharge rules apply on top.
